§ 8-22. Same—January 6, 1958.

  • Whereas, Transcontinental Gas Pipe Line Corporation, a Delaware Corporation (hereinafter called Transcontinental), has obtained from the Federal Power Commission a Certificate of Public Convenience and Necessity to construct a pipeline known as the Mecom-San Jacinto Lateral which will be located within the Parish of Cameron, State of Louisiana (as defined by Act No. 32 of the Louisiana Legislature for the year 1954); and

    Whereas, Transcontinental has applied for permission to lay, maintain and operate said line for the transportation of natural gas or other products which can be transported through a pipeline within and through the Parish of Cameron, State of Louisiana, together with appliances, tie-overs and appurtenances necessary or convenient in the operation thereof:

    (1)

    It appears to the best interest of the Parish of Cameron that the request of Transcontinental be granted.

    (2)

    Consent is given by the Parish of Cameron to the construction of the hereinabove described pipeline along a route approximately as shown on Transcontinental Gas Pipe Line Corporation Drawing hereto attached, and particularly, is consent given to the construction of said pipeline offshore the Parish of Cameron in the Gulf of Mexico.

    There is hereby granted to Transcontinental, its successors and assigns a nonexclusive franchise, right and privilege to construct, operate and maintain said pipeline together with appliances, tie-overs and appurtenances necessary or convenient in the operation thereof (including cathodic protection equipment and microwave facilities) in, over, through, across and along the public roads, highways, streets, alleys, ditches, streams, bayous, creeks, canals, lakes, levees, rivers, lands and other properties under the jurisdiction of the police jury of Cameron Parish if same is constructed in accordance herewith and with any requirements of the State of Louisiana, the United States of America, or any department of either having supervision over same.

    The right to run along, across, over or under the public streets, roads, highways and alleys, as above provided, only may be exercised upon condition that the traffic thereon not be interfered with and that same be restored promptly to its former condition or usefulness at the expense of Transcontinental Gas Pipe Line Corporation; the restoration thereof to be subject to the supervision of the police jury of this parish; provided, further, that if ditches, canals or levees under the jurisdiction of a drainage district are crossed, Transcontinental will obtain consent from such drainage district and will conduct the work under the supervision and control and in the manner directed thereby.

    (5)

    In the exercise of the privileges herein conferred upon it, Transcontinental shall compensate the Parish of Cameron for any damage occasioned to it.
