§ 8-20. American Louisiana Pipeline Company.

  • (a)

    There is hereby granted to American Louisiana Pipeline Company, a corporation organized and created under the laws of the State of Delaware, its successors and assigns, a nonexclusive franchise, right and privilege to construct, operate and maintain a pipeline or pipelines under and across levees, bayous, streams, canals and other bodies of water within the Parish of Cameron which are under the jurisdiction of the police jury provided the pipeline crossings are buried a sufficient depth so that they will not interfere with drainage in said waterways and provided further that upon the completion of the construction of such crossings, the trench or ditch in which the pipe is laid will be leveled in such a manner as not to interfere with drainage in said streams and a nonexclusive franchise right and privilege to construct, operate and maintain in, over, along and under the parish public highways and parish roads of the Parish of Cameron, Louisiana, not within the limits of any incorporated city, town or village, a pipeline, or pipelines when constructed in accordance with the requirements adopted by the director of highways of the State of Louisiana, with respect to pipelines laid under state highways; provided however, that the president of the police jury may dispense with such of said requirements as, in his opinion are not necessary or requisite.

    (b)

    This ordinance is issued under and by virtue of the various acts of the Legislature of the State of Louisiana, authorizing the police juries of the parishes of said state to grant franchises for the crossing of the roads, highways levees, bayous, streams, canals and other bodies of water of the various parishes and where said pipelines cross state highways they shall be governed by the provisions of the state highway acts applicable thereto.

    (c)

    The grantee herein named in accepting this franchise agrees and guarantees to hold harmless the police jury of the Parish of Cameron, Louisiana, and its individual members from any and all loss, damage or expense which they may suffer on account of the grant of this franchise and privilege and operations thereunder arising from any cause whatsoever in favor of any person, persons, partnership or corporation, and further agrees that it will repair all damages to highways, roadways or bridges resulting from the construction of said highway crossings and will replace the same in as good condition as existed prior to the construction work.

    (d)

    This franchise shall continue in full force and effect for a period of ninety-nine (99) years from and after the date of the adoption of this ordinance.
