Article I. ELECTRICITY |
§ 8-1. Jefferson Davis Electric Cooperative, Inc.
(a)
The right, privilege and franchise is hereby granted for a period of ninety-nine (99) years from the date this ordinance takes effect, to the Jefferson Davis Electric Cooperative, Inc., its successors and assigns, to construct, maintain and operate lines of poles and wire for the transmission of electric current for heat, light or power, over the public roads, streets, or alleyways in the Parish of Cameron, Louisiana, not within the limits of any city, town or village which is incorporated; to manufacture, conduct and carry on the business of furnishing electric light and illumination; to supply the Parish of Cameron, Louisiana, the public generally with electric lights for illumination and electricity for motive power, to light the streets, public places, public or private buildings, factories and other things or places by means of electricity and to enable the same to be lighted; to carry on the business of supplying heat and power with the right to use or manufacture and put up dynamos, accumulation lamps, and all appliances now known or that may be known or hereafter invented and connected with generation, accumulation, distribution and supplying of electricity or any power that can be used as a substitute thereof, including cables, wires or appliances in connection with the manufacture and sale of electricity; to erect, construct, maintain and operate a line or lines of poles, wires, etc., for the transmission of electric energy, over, along, under and across the public roads and state highways, streets and alleyways, within the Parish of Cameron, Louisiana, (not within the limits of any incorporated city, town or village), for the purpose of transmitting, distributing and supplying electricity for light, heat and power, including the right to erect and construct towers, cables, guy wires, anchors, stubs, and braces, and all other necessary and proper fixtures and appliances, in, on, along, over, under and across the said public roads and state highways, or any one or more of them, within the Parish of Cameron, Louisiana (not within the limits of any incorporated city, town or village) as follows:

All state highways within the Parish of Cameron, Louisiana, as designated in Act 95 of the legislature of the state for the year 1921.
(2)
All other state highways and public roads and streets outside of the corporate limits of any incorporated city, town or village within the Parish of Cameron, Louisiana.
This right, privilege and franchise is granted under the provisions of Act 127 of the legislature for the year 1924, and is nonexclusive.
(b)
The location and/or relocation of all lines, poles and structures on state highways and on any road not constituting part of the state highway system but which is a public road, is subject to the approval of the police jury of the Parish of Cameron, Louisiana, and said lines or poles, wires and structures shall not at any time interfere with the use, repair, maintenance or drainage of any such state highway or public road. Any expenses incurred by the Louisiana highway commission or police jury for the Parish of Cameron, Louisiana, in connection with the location and/or construction of poles other structures pursuant to this grant, shall be borne by the grantee.
(c)
The grant of these rights, privileges and franchise of state highways within the Parish of Cameron is subject to the written approval of the Louisiana highway engineer, and it is stipulated that no work on said state highways done pursuant to the grant of these privileges, rights and franchise, shall be in any manner contrary to or in conflict with the existing laws of the state or rules and regulations of the Louisiana highway commission. The grantee shall protect and save harmless the grantor and the Louisiana state highway commission from any and all claims arising from and growing out of the exercise of any rights or privileges granted by virtue of this ordinance.
(d)
The grantee, its successors and assigns, shall at all times maintain such lines in good condition, and comply with all reasonable and safety requirements in the operation thereof. All wires crossing said state highways or public roads shall, at all times, clear the surface thereof by at least twenty-two (22) feet.
(e)
It is understood and agreed that this franchise, or grant is not an exclusive grant or franchise and the police jury is at liberty to make other similar grants or franchise.
(f)
The consideration for which this franchise and the rights herein are granted is the mutual benefit which will be vested in the residents of the Parish of Cameron, Louisiana.
(g)
This ordinance and the rights, privileges and franchise herein granted, shall become effective from and after its passage, and the formal acceptance by the grantee in writing.
