§ 2-23. Accumulated leave.

  • (a)

    Annual Leave. Subparagraphs (1), (2), and (3) are only applicable to annual leave accrued to an employee's credit prior to January 1, 2011. Effective January 1, 2011, no employee may accumulate annual leave in whole or in part.

    (1)

    Upon resignation, death, removal or other termination of employment of an unclassified employee, annual leave accrued to his credit after June 1, 1992, shall be computed and the value thereof shall be paid to him or his heirs, provided that the annual leave has been accrued under established leave regulations and daily attendance record has been maintained for the employee by his supervisor, except that such payment shall not exceed three thousand dollars ($3,000.00). The rate of pay shall be computed at the rate the employee is receiving at the time of termination.

    (2)

    Annual leave accrued to an employee's credit after June 1, 1992, may be used to extend employment date in an amount not to exceed the total number of annual leave days earned in the preceding calendar year. Any remaining annual leave accrued in an employee's credit after June 1, 1992, shall be used only to enhance his retirement pension and shall not be considered a liability of the police jury.

    (3)

    Any part of annual leave accrued to an employee's credit prior to June 1, 1992, may be added to any annual leave accrued after June 1, 1992, in order to make total value and total payment of three thousand dollars ($3,000.00) upon resignation, death, removal or other termination of employment. Any remaining annual leave accrued prior to June 1, 1992, and not used in calculating the three thousand dollars ($3,000.00) payment as set forth hereinabove, may be used to extend employment date for the total number of any such remaining annual leave days.

    (b)

    Sick Leave. In no instance shall an employee be paid for any accumulated sick leave left to an employee's credit at the time of termination from service.

    (c)

    Retirement. Upon retirement, accumulated sick leave may be used to enhance the employee's retirement pension; however, it may not be considered a part of service time. Annual leave accumulated prior to January 1, 2011 may be used to enhance the employee's retirement pension; however, it may not be considered a part of service time. No annual leave may be accumulated subsequent to January 1, 2011.

    (d)

    Districts. All districts created by the police jury shall adhere to the same annual leave and sick leave policies.
