§ 14-60. Speed limits for beach areas.

  • (a)

    It shall be unlawful to operate any motor vehicle or off-road vehicle at the following locations in Cameron Parish at a speed in excess of ten (10) miles per hour:

    (1)

    Holly Beach area: All beach areas from the Calcasieu Ship Channel (on the east) to the Louisiana-Texas state boundary line (on the west).

    Rutherford Beach area: State Lease No. 2663—Commence at the NW corner of Section 7, T15S, R7W; thence, go S 00°50′01" W a distance of 1933.20 feet along the range line between R7W and R8W to the point of beginning, being the approximate landward limits of the seashore; thence, along said range line N 00°50′01" E a distance of 133.20 feet to a point on the north right-of-way of Gulf Drive; thence, S 77°11′20" E a distance of 408.90 feet to a point; thence, S 77°11′18" E a distance of 255.56 feet to a point; thence, S 77°12′55" E a distance of 306.65 feet to a point; thence, S 79°31′06" E a distance of 202.87 feet to a point; thence, S 83°37′44" E a distance of 207.77 feet to a point; thence, S 87°14′18" E a distance of 150.08 feet to a point; thence, N 88°01′11" E a distance of 400.48 feet to a point; thence, N 86°34′43" E a distance of 451.24 feet to a point; thence, N 86°33′ 26" E a distance of 401.12 feet to a point; thence, N 86°34′ 06" E a distance of 366.90 feet to a point at the intersection of the north right-of-way of Gulf Drive and the 1876 S.P. Henry Meander Line; thence, along the 1876 S.P. Henry Meander Line, S 72°38′ 29" E a distance of 48.09 feet to a point; thence, S 72°38′ 16" E a distance of 399.65 feet to a point; thence, S 72°38′ 24" E a distance of 129.80 feet to a point; thence, S 72°38′20" E a distance of 623.90 feet to a point; thence, S 83°06′23" E a distance of 1122.51 feet to a point; thence, S 83°09′15" E a distance of 2284.89 feet to a point; thence,S 86°08′31" E a distance of 1387.34 feet to a point; thence, N 87°21′ 45" E a distance of 302.80 feet to a point at the intersection of the 1876 S.P. Henry Meander Line with the extension of the east edge of the old location canal; thence, along the east edge of the old location canal, S 20°41′26" W a distance of 435.31 feet to a point; thence, S 20°21′02" W a distance of 427.35 feet to a point; thence, S 19°47′08" W a distance of 399.40 feet to a point on a fence line; thence, along a fence line, S 35°48′16" W a distance of 131.94 feet to a point; thence, S 11°33′01" W a distance of 77.53 feet to a point; thence, S 17°36′ 50" W a distance of 246.78 feet to a point on the approximate landward limits of the seashore; thence, along the landward limit of the seashore of the Gulf of Mexico in a northwest direction approximately 9,100 feet to the point of beginning.

    (a.1)

    Notwithstanding the above provisions; these vehicles are not allowed at the following beaches:

    (1)

    Holly Beach area. Off-road vehicles or vehicles without a valid vehicle license are prohibited from a point one-half (½) mile east of Barataria Boulevard (Parish Road 502) and Beach Post #1 on the east side of Holly Beach, to a location one-half (½) mile west of Riveria Lane (Parish Road 513) and Beach Post #30 on the west side of Holly Beach; and

    (2)

    Johnson Bayou area. Off-road vehicles, vehicles without a valid vehicle license and motor vehicles, are prohibited from Prioux Lane (Parish Road 519) on the west, to an easterly location four and one-half (4.5) miles, more or less, which marks the beginning of the erosion fencing at the new sand-filled beach area.

    (3)

    Rutherford Beach area. Off-road vehicles, vehicles without a valid vehicle license and motor vehicles are prohibited from the designated area identified by signage, beginning from the dune area located approximately seven hundred sixty (760) feet west of Rutherford Beach Drive, eastward approximately one and one-quarter (1.25) miles, ending at the eastern edge of the state lease line.

    (b)

    Beaches shall be defined as a shore of any body of salt water, a shore of a lake, being a large inland body of fresh or salt water, or the bank of a river covered, at least in part, with sand, shell, gravel, or larger rock fragments and situated within the boundaries of Cameron Parish, Louisiana;

    (c)

    Motor vehicle shall be defined as every vehicle which is self-propelled and shall include but is not limited to an "autocycle", "motorcycle", a "motor-driven cycle", and "motorized bicycle", all as defined pursuant to LSA R.S. 32:1;

    (d)

    Off-road vehicle shall be defined as any vehicle which cannot be licensed by the State of Louisiana, including dirt bikes, four wheelers, three wheelers, all-terrain vehicles and golf carts; and

    (e)

    Whoever shall violate the provisions of this article shall, upon conviction be fined not more than three hundred dollars ($300.00) or imprisoned in the parish jail for not more than thirty (30) days, or both, at the discretion of the court.

    (f)

    The provisions of this section (14-60) shall not apply to law enforcement and life-saving personnel and emergency vehicles.
